This ExultsX Privacy Policy explains how Search Engine Operator, Inc. d/b/a Exults (“Exults”, “We”, “Us” or “Our”) collects, stores, processes, shares and uses information collected when You (“You”, “Your” or “User”) access or use the ExultsX platform, functionality, plug-ins, add-ons and related programs (collectively, the “Services”). By registering for an ExultsX account or using the Services, You signify that You agree to be bound by this ExultsX Privacy Policy. If You do not agree to the terms of this ExultsX Privacy Policy You must discontinue using the Services immediately.

WHAT INFORMATION WE COLLECT

We generally collect the following information: (1) technical data passively collected from You and any individuals who use the Services (“Technical Data”); and (2) information that You voluntarily submit to Us about You, Your company and/or Your clients (“User Data”).

Technical Data Collection

We collect general technical data that is not personally identifiable such as device information, IP address and browser type. We collect this information through registration forms, click tracking, automatic logging files, etc. Other information We request is optional. We use cookies to allow You to move quickly through the ExultsX platform, to recognize repeat visitors, and to allow You to take advantage of some of Our Services’ special features. We also use cookies to collect Services usage information, estimate Our total audience size and traffic, and help Us improve Our Services’ experiences by measuring which areas are of greatest interest to users.

A cookie is a string of information that is sent by a website and stored on Your hard drive or temporarily in Your computer’s memory. If You register for an ExultsX account to access or use the Services, We collect personal information about You and Your company such as contact information (including name, billing address, e-mail and telephone number), business information (including details about Your law firm, its practice areas, its team members and its clients), and payment information (such as financial information including bank account number, credit card number and expiration date and other information including credit scores obtained from credit reference agencies).

HOW WE USE YOUR INFORMATION 

We use this information to provide You access to the Services, to improve the Services, for billing and payment processing and for marketing purposes.

We will occasionally send You information via email about Our Services and special deals/promotions. We may use personal information We collect about You to help Us determine the most relevant information to share with You. If You prefer not to receive any marketing communications from Us, You may opt out of these types of communications by sending an e-mail to Us at zach.hoffman@exults.com

We may disclose Technical Data and User Data to (i) an affiliate (limited to a parent company, subsidiaries, joint venture partners or other companies that We control or that are under common control), (ii) an acquirer of Exults, or (iii) a successor by merger or equity purchase.

We may disclose Technical Data and User Data if We have a good-faith belief that doing so is required by a subpoena or other judicial or administrative order or otherwise required by law or in connection with an actual or proposed corporate transaction or insolvency proceeding involving all or part of the business or asset to which the information pertains. This may include responding to legal requests from jurisdictions outside of the United States, where We have a good faith belief that the response is required by law in that jurisdiction.

Data Retention

We keep Your personal information no longer than necessary for legitimate business purposes or as required by law.

Security

The security of Your information is important to Us. The personal information We collect about You is stored in limited-access servers behind a firewall. We will maintain safeguards to protect the security of these servers and Your personal data. Change of Ownership

In the event of a change in ownership, or a merger with, acquisition by, or transfer, or sale of all or a portion of Our assets to, another entity, We reserve the right to transfer all of Your personal information, including email addresses, to that entity. We will use reasonable efforts to notify registered Users of any such transfer to an unaffiliated third party (by a posting on Our homepage, or by email to Your email address that You provided to Us, as chosen by Us at Our discretion).

If We make any material changes, We will give You a reasonable opportunity to consent to the change. By using the Services after the Effective Date, You are deemed to agree the terms of the updated ExultsX Privacy Policy.
